Suspension of Enforcement Proceedings! What Does That Mean?

To date, various measures have already been adopted to combat the spread of the coronavirus. One of them is the "shutdown" of the economy, where businesses are closed when people gather there or switch to home office.

This has a direct impact on the liquidity of businesses and can lead to a so-called liquidity shortage and thus payment difficulties.

Federal Council Emergency Measures

To protect businesses and the economy as much as possible, the Federal Council has adopted various emergency measures. One of the emergency measures is the nationwide so-called suspension of enforcement proceedings, which the Federal Council has ordered for the first time since 1914.

Together with the regular enforcement holidays seven days before and after Easter, this means a pause for all enforcement proceedings until April 19. The basis for this is an article in the Federal Act on Debt Enforcement and Bankruptcy (SchKG).

What Does Suspension Mean?

A suspension means a pause for all enforcement proceedings. After the end of the suspension, the proceedings will be resumed and continued.

The Federal Council justifies its decision with the need to reorganize customer contact in the enforcement offices. Additionally, companies are to be given a breather in these economically difficult times. The Federal Council has clearly acknowledged that this suspension is not a long-term solution.

Impact on Cashare
